The manufacturing and shipping process employed by our manufacturing partner, EBorn, includes rigorous quality assurance which has resulted in each of our products being shipped, delivered and received by the customer without incident. However, in the event there is an issue in the future, we offer the following instructions:
It is important to inspect the shipping container upon receipt. In the event there is noticeable damage to the container and the material the customer should refuse shipment. If there is minor damage to the container and it is not possible to verify damage to the interior contents the customer should be sure to note the damage on the delivery receipt. Notify the delivery company immediately and open the contents with the freight company inspector present. If the damage is not apparent upon receipt, and not identified until opened (hidden damage), the customer should stop and immediately notify Metal-Tex and the freight company and await further instructions.
If the material is to be stored prior to installation we highly recommend that the case be opened and inspected upon receipt as freight companies have short windows to file a claim. It is recommended that the shipping container be saved in case the product needs to be returned.
Metal-Tex and its manufacturing partner EBorn will correct any defect called to our attention in writing within twelve (12) months of date of shipment, caused by faulty materials or workmanship. The buyer’s exclusive remedy shall be the repair and/or replacement of defective parts by Metal-Tex and/or EBorn at the sole judgement of Metal-Tex. This shall be done at no expense to the buyer.
The parties further agree that no other remedy (including, but not limited to, incidental or consequential damages for lost profits, lost sales, injury to person or property, negligence in the design, installation, or repair of the product, or any other incidental or consequential loss) shall be available. The parties further agree that all other warranties, express or implied (including but not limited to any implied warranty of merchantability or fitness for a particular purpose) are excluded. This warranty does not apply to (1) products damaged by accident, neglect, misuse, natural disaster or abuse or (2) costs of removal or re-installation of defective products.
